State and federal court cases have made clear that social workers' investigations of child abuse and removal of minors are subject to the warrant requirement of the Fourth Amendment.

Warrants protect individual family member's Fourth Amendment right against unreasonable searches and seizures, as well as the parents' and children's Fourteenth Amendment right to live together without government interference, and thus not to be separated by the state without due process of law
